Preamble and legal information
These general terms and conditions of sale (the T&Cs) govern the sale of Izzytab products made on the izzytab.com website between the company Izzytab and its customers, whether consumers or businesses. They are accessible at all times on the website and prevail over any other document.
Seller: Izzytab, a single-shareholder simplified joint-stock company (SASU) with share capital of 3 000 €, registered with the Lyon Trade and Companies Register under number 993 270 958, whose registered office is located at Espace Florentin, 59 Chemin du Moulin Carron, 69570 Dardilly, France. Intra-community VAT number: FR46993270958. Contact: bonjour@izzytab.com.
The website is hosted by Vercel Inc. (application) and Supabase (database), which can be reached via their respective websites.
Article 1. Definitions
Customer: any natural or legal person who places an order on the website. Consumer: any natural person acting for purposes that are outside the scope of their commercial, industrial, craft, professional or agricultural activity.
Products: the items offered for sale by Izzytab (effervescent cleaning tablets, IzzyBloom essential oils, Izzykits kits, individual refills) as well as the box subscriptions described in Article 9.
Order: any request to purchase Products validated and paid for by the Customer. Account: personal space created by the Customer on the website to place and track orders. Stripe: third-party payment service provider ensuring the secure processing of transactions.
Article 2. Purpose and acceptance
The purpose of these T&Cs is to define the conditions of order, price, payment, delivery, withdrawal, return and warranty applicable to the Products sold by Izzytab.
Any order placed on the website implies full, entire and unreserved acceptance of these T&Cs, which the Customer acknowledges having read and accepted before validating payment, by means of a checkbox or an equivalent mechanism. Izzytab reserves the right to modify its T&Cs at any time; the applicable T&Cs are those in force on the date of the order.
Article 3. Products and availability
The Products are presented with the greatest possible accuracy (descriptions, compositions, images, contents). Photographs and illustrations do not fall within the contractual scope and shall not engage Izzytab's liability in the event of a minor difference in appearance.
Product offers are valid as long as they are visible on the website and within the limits of available stock. In the event that a Product is unavailable after an order has been placed, the Customer is informed as soon as possible and is refunded without delay the sums corresponding to the unavailable Product.
Article 4. Prices and taxes
Prices are displayed in euros, all taxes included, for France. The price per unit of measure (per litre or per kilogram after reconstitution where applicable) is indicated on each product page. Izzytab reserves the right to modify its prices at any time; the Product is invoiced at the price in force at the time the order is validated.
French VAT at the rate in force (20%) applies to deliveries in France. For deliveries to another country of the European Union, the VAT applied is that of the country of destination (One Stop Shop OSS scheme), calculated automatically at the time of payment. Businesses holding a valid intra-community VAT number benefit from the reverse charge mechanism (amount excluding tax).
For deliveries outside the European Union, prices are established excluding tax: any customs duties, import taxes and formalities are the exclusive responsibility of the recipient. Delivery charges are indicated separately before the order is validated and are added to the price of the Products.
Article 5. Order
The Customer selects the Products, adds them to the basket, checks the details of the order, enters delivery and billing details, accepts these T&Cs and then proceeds to payment. The sale is definitively concluded after confirmation of payment.
A summary email confirming the order is sent to the Customer at the address associated with the Account. The computerized records of Izzytab and Stripe constitute valid proof of transactions, in accordance with articles 1366 et seq. of the Civil Code. It is the Customer's responsibility to keep the order documents.
Izzytab reserves the right to refuse or cancel any order that is abnormal, made in bad faith, fraudulent, or in the event of a prior dispute relating to the payment of a previous order.
Article 6. Payment
Payment is made by bank card, Apple Pay, Google Pay, PayPal or Link, securely via Stripe. The total amount is due upon order.
Stripe is PCI-DSS Level 1 certified, the highest standard in the industry. The Customer's banking data (card number, expiry date, security code) is at no time collected, stored or processed by Izzytab: it is transmitted in encrypted form to Stripe's secure servers. Use of Stripe's services is subject to its own terms for the technical and operational aspects of payment.
In the event of refusal of payment authorization by the accredited bodies or in the event of non-payment, the order is automatically cancelled and the Customer is informed.
Article 7. Delivery
The Products are delivered to the address indicated by the Customer when ordering. Orders are shipped by the carrier selected by the Seller. Delivery is free from 39 euros of purchase in France; below this threshold, a delivery charge of 3.90 euros applies. Internationally, delivery is charged and calculated according to weight and destination, the exact amount being displayed before the order is validated.
Delivery times are indicated for information purposes at the time of ordering. In accordance with article L.216-1 of the Consumer Code, in the absence of any indication or agreement, Izzytab delivers without undue delay and no later than thirty (30) days after the conclusion of the contract. In the event of delay, the Customer may, under the conditions of article L.216-6, require Izzytab to deliver within a reasonable additional period and then, failing that, terminate the contract and be refunded.
In the event of absence when the carrier passes, the Customer follows the instructions left to arrange a new presentation or collection at a pick-up point. The Customer is invited to check the condition of the parcel on receipt and to report any anomaly (damaged parcel, missing Product) to customer service as soon as possible.
Article 8. Transfer of ownership and risk
The Products remain the property of Izzytab until full payment of the order. In accordance with article L.216-4 of the Consumer Code, the transfer of the risks of loss or damage to the Products takes place upon physical delivery of the Products to the Customer or to a third party designated by them, other than the carrier proposed by Izzytab.
Article 9. Box subscription
Izzytab offers a subscription to a recurring box, whose delivery frequency is chosen by the Customer (1, 2 or 3 months). The subscription is without any commitment period and can be cancelled at any time. The subscriber benefit applies to the price of the Products; delivery charges remain payable for each delivery.
At each due date, the Product or the assortment of the box is prepared, the corresponding payment is automatically charged via Stripe to the registered payment method, and the box is then shipped. The Customer is free to suspend, change the frequency of or cancel the subscription at any time from the personal space. Cancellation or modification made before the preparation of the next due date takes effect for that due date; any box already prepared or shipped remains payable.
The right of withdrawal provided for in Article 10 applies to the first subscription order under ordinary law conditions. Subsequent deliveries of the box are governed by a contract for successive supply that is duly renewed as long as the Customer does not cancel.
Article 10. Right of withdrawal
In accordance with articles L.221-18 et seq. of the Consumer Code, the Customer who is a consumer has a period of fourteen (14) days from receipt of the Products to exercise the right of withdrawal, without having to give reasons for the decision or bear any costs other than those provided for by law. Where the order concerns several Products delivered separately, the period runs from receipt of the last Product.
To exercise this right, the Customer notifies the decision before the expiry of the period, by an unambiguous statement, by email to bonjour@izzytab.com or by post to the registered office. The Customer may use the standard withdrawal form, although this is not compulsory. Izzytab acknowledges receipt.
Exception (hygiene and health protection): in accordance with article L.221-28 3° of the Consumer Code, the right of withdrawal cannot be exercised for Products that have been unsealed after delivery and that cannot be returned for reasons of hygiene or health protection. This exception applies in particular to cleaning tablets and essential oils whose protective packaging has been opened. Returned Products must therefore be intact, unsealed and in their original packaging.
Article 11. Returns and refunds
In the event of a valid withdrawal, the Customer returns the Products without undue delay and no later than fourteen (14) days after having communicated the decision. The direct costs of return are borne by the Customer, except where the return follows a defective, non-compliant or mistakenly shipped Product, in which case Izzytab bears them. Independently of the right of withdrawal, returns are accepted within 30 days for intact and unsealed Products.
Izzytab refunds all payments received, including the initial standard delivery charges, no later than fourteen (14) days from receipt of the withdrawal decision. Izzytab may defer the refund until recovery of the Products or until proof of their shipment by the Customer, the date used being that of the first of these events. Once the return has been received and checked, the refund is made via Stripe, to the original payment method, within 5 business days.
The Customer may be held liable in the event of depreciation of the Products resulting from handling other than that necessary to establish their nature, characteristics and proper functioning.
Article 12. Legal warranties
Izzytab is liable for defects in the conformity of the Products under the conditions of articles L.217-3 et seq. of the Consumer Code. The Customer who is a consumer has a period of two (2) years from delivery of the Product to act under the legal warranty of conformity. The Customer may choose between repair or replacement of the Product, subject to the cost conditions of article L.217-12, and then, failing that, obtain a reduction in price or termination of the sale (articles L.217-14 et seq.). The Customer is exempt from providing proof of the existence of the defect in conformity during the twenty-four (24) months following delivery.
Izzytab is also bound by the warranty relating to hidden defects in the item sold under the conditions of articles 1641 et seq. of the Civil Code. In this context, the Customer may choose between termination of the sale or a reduction in the sale price (article 1644 of the Civil Code). Action resulting from hidden defects must be brought within a period of two (2) years from discovery of the defect.
The implementation of the legal warranties is carried out free of charge for the Customer. To benefit from them, the Customer contacts customer service at bonjour@izzytab.com, providing all useful information (order reference, description of the defect, any photographs). These legal warranties apply independently of any commercial warranty.
Article 13. Product safety and documentation
In accordance with Regulation (EC) No 648/2004 on detergents, the complete list of ingredients of each Product concerned is published on its page, freely and free of charge. The safety data sheets (SDS) and certificates (Ecocert Ecodetergent, Made in France) can be downloaded in PDF format from each product page.
Hazard statements and precautionary statements (CLP regulation), as well as the UFI code where applicable, appear on the Product's label. Sorting instructions (Triman, Info-tri, AGEC law) are indicated on the packaging. The Customer undertakes to comply with the precautions for use and the instructions for use and storage appearing on the Products and their documentation.
Article 14. Liability
Izzytab is responsible for the proper performance of the obligations resulting from the distance sales contract concluded, in accordance with articles L.221-15 et seq. of the Consumer Code. Izzytab may be exonerated from all or part of its liability by providing proof that the non-performance or improper performance of the contract is attributable either to the Customer, or to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure.
Izzytab shall not be held liable for any use of the Products that does not comply with their intended purpose, the precautions for use or the documentation provided. Within the limits authorized by law and subject to bodily injury and gross or intentional misconduct, Izzytab's liability shall not be engaged for indirect damages.
Article 15. Personal data
The personal data collected when creating the Account and placing orders is processed by Izzytab, as data controller, in compliance with the General Data Protection Regulation (GDPR) and the amended French Data Protection Act.
The processing terms, purposes, legal bases, recipients, retention periods and Customer rights are detailed in Izzytab's privacy policy, accessible on the website. The Customer may exercise these rights and ask any question relating to their data at bonjour@izzytab.com.
Article 16. Customer service and complaints
For any question, information or complaint relating to an order, customer service can be reached at bonjour@izzytab.com or by post to Izzytab, Espace Florentin, 59 Chemin du Moulin Carron, 69570 Dardilly, France. Izzytab undertakes to provide a response within 5 business days.
Article 17. Consumer mediation
In accordance with articles L.612-1 et seq. of the Consumer Code, the Customer who is a consumer may, in the event of the failure of any prior written complaint to Izzytab's customer service or in the absence of a response within a period of thirty (30) days, have free recourse to a consumer mediator with a view to the amicable resolution of the dispute.
The competent consumer mediator is: Centre de la Médiation de la Consommation (CM2C), 49 Rue de Ponthieu, 75008 Paris. The Customer may also use the European online dispute resolution platform: ec.europa.eu/consumers/odr.
Article 18. Force majeure
Neither party may be held liable for a failure to fulfil its obligations resulting from a case of force majeure within the meaning of article 1218 of the Civil Code and French case law.
The following are in particular likely to constitute cases of force majeure, without this list being exhaustive: natural disasters, fires, floods, epidemics, pandemics, armed conflicts, terrorism, general or sectoral strikes, supply disruptions beyond Izzytab's control, major failures of transport, telecommunication or electricity networks, and decisions of the public authorities. The prevented party informs the other as soon as possible and implements reasonable means to limit the effects.
Article 19. Modification of the T&Cs
Izzytab reserves the right to modify these T&Cs at any time in order to take account of legal, regulatory, technical or commercial developments. The T&Cs applicable to an order are those in force and accepted by the Customer at the time this order is validated. Modifications have no retroactive effect on orders already placed.
Article 20. Applicable law and language
These T&Cs are subject to French law. This provision may not deprive the consumer residing in another Member State of the European Union of the mandatory protection provisions recognized by the law of their country of residence.
In the event of a dispute, an amicable solution will be sought before any legal action. Failing that, the French courts have jurisdiction under the conditions provided for by law. These T&Cs are drawn up in French and may be offered in translation into other languages for information purposes; in the event of any discrepancy in interpretation, only the French version is authoritative and shall prevail.
Article 21. General provisions
These T&Cs express the entirety of the agreement between the parties relating to the sale of the Products. If one of the provisions were to be declared null or unenforceable pursuant to a law, a regulation or a court decision, the other provisions would retain all their force and scope.
The fact that Izzytab does not avail itself at a given time of one of these provisions may not be interpreted as a waiver of the right to avail itself of it subsequently.
